When Employees Aren’t Well and It’s Difficult to Tell: Detecting and Accommodating Hidden Disabilities with Eric Dowell of Ogletree, Deakins, Nash, Smoak & Stewart, P.C.


According to the Centers for Disease Control and Prevention, one out of every five American adults has a disability.  An employee who has no visible impairment or assistive device may still present accommodation needs.  They may appear completely healthy, but in reality may still be dealing with hidden afflictions, such as debilitating pain, cognitive challenges, learning differences, mental health disorders, or other non-visible conditions.  I will explore best practices for detecting and accommodating hidden disabilities and discuss how job performance discussions, reasonable accommodation requests, and disciplinary decisions can interact and lead to good, bad, or ugly results for employers and employees.
