An Arizona Employer Nightmare: Drug-Testing Employees Who Are Medical Marijuana Users, by J. Alexander Dattilo, Labor & Employment Attorney at Jackson Lewis P.C.; Jaime Anderson, Laboratory Manager at TASC; and Patricia Playman, VP of Human Resources at Community Medical Services.

In this session, Mr. Dattilo will provide an overview of Arizona law on employee drug-testing as it relates to medical marijuana users, including ramifications of a recent decision in Whitmire v. Wal-Mart. Ms. Anderson will explain various methods available to screen for marijuana use, including the pros and cons of each one. Ms. Playman will discuss practical issues that Human Resources representatives are likely to encounter with respect to drug-testing medical marijuana users. Participants will be provided with legal updates designed to help identify potential issues their current organization’s drug-testing policy, information regarding recent developments in drug-testing methods, and practical insight into the rapidly-changing legal landscape that controls drug-testing of employees who are medical marijuana users.


The Arizona Industrial Commission’s Latest Agency Update on Arizona’s Paid Sick Leave Law by Arizona Industrial Commission Program Project Specialist Victoria Kamm and Investigator Jennifer Krainski. 

Have questions about how to properly manage employee sick leave post Arizona’s Paid Sick Leave Law?  You aren’t alone!  Please join us in welcoming Arizona Industrial Commission Program Project Specialist Victoria Kamm and Investigator Jennifer Krainski who will be discussing the Arizona Paid Sick Leave Law, addressing the most frequently asked questions they receive, and walking us through what is encompassed in an Industrial Commission investigation.

Ms Kamm is the Program and Project Specialist/Lead Investigator at the Arizona Department of Labor.  Ms Kamm handles the review of claims and quality control for Investigations.  Ms Kamm has six years’ experience with Regulatory Investigations.  Prior to working for the Labor Department, Ms Kamm retired from the veterinary field after 40 years of service as a Certified Veterinary Technician and Practice Manager. 

Ms. Krainski is an Investigator with the Arizona State Department of Labor.  Ms. Krainski conducts Investigations for Earned Paid Sick Time, Retaliation, Wage Claim, Minimum Wage and Youth Labor cases. Ms. Krainski has eight years of experience in the Investigations field. Prior to working for the Labor Department, Ms. Krainski worked as a Private Investigator and has experience in Sanctions Investigations in the financial industry.

EEOC Agency Update and Hot Topics by Mary Jo O’Neill, Regional Attorney, Phoenix District Office, Equal Employment Opportunity Commission

In this session, Ms. O’Neill will provide an updated regarding the legal and enforcement activities at the Equal Employment Opportunity Commission.  She will also cover discrimination and harassment hot topics that impact employers.  Participants will be provided updates so that they can ensure their organization stays in compliance and can prepare for anything coming in the future.
